We will continue to refer to you in this document as "Controller" (or "we" to make the document easier to read) and we will refer to you as "you", sometimes also as "data subject").

When you visit our site and browse, two things happen in the course of this activity - the storage of cookies and the processing of personal data (especially if you fill in any of our forms).

In view of this, we are the so-called data controller and have a kind obligation to inform you about how we process your personal data.

In the virtual world, the term cookie is used to refer to a small, short text file that is stored in your browser when you visit a website. This small and short file then gives us information about, for example, what browser you use, what language you prefer and allows us to display the website in a way that is pleasant for you.

In addition, there are other types of cookies, such as advertising cookies or analytics cookies, which allow us to generate aggregate statistics and thus to adapt our site to make it more enjoyable for everyone.

  1. What is personal data?

The definition of personal data is quite complex (personal data is information about an identified or identifiable person). If we were to simplify it as much as possible, personal data is any information that you have disclosed to us or that we have about you. For the purposes of this document we provide the following examples:

  1. On what basis can you process my personal data?

The conditions under which we may process personal data about you are determined by the GDPR. We may (and sometimes must) process your personal data for the following reasons:

  • you gave us permission to do this;
  • the processing is necessary for the performance of a contract that we enter into or are about to enter into between us;
  • the processing is necessary for compliance with a legal obligation to which we are subject;
  • processing is necessary to protect your vital interests (or those of another natural person);
  • the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in us;
  • the processing is necessary for the purposes of legitimate interests, whether ours or a third party.

  1. How do you process personal data about me, for how long and why?

You are in full control of how and when we process personal data. Each collection of personal data is preceded by a short sentence in which we tell you for what purposes we will process your personal data.

In case you buy from us, or give us your consent, we will be happy to send you a newsletter or other e-mail from time to time to let you know what is new with us. Such a communication then meets the definition of a commercial communication and we need your consent to send it to you, or we can do this without your consent if you have already purchased something from us in the past.

In this case, the processing of personal data may involve, for example, profiling, where we do not want to send you messages that you are not interested in or that are not relevant to you.

  1. Who has access to personal data?

We treat your personal data as responsibly as if it were our own, and in the vast majority of cases only we, or our employees and persons in a similar position, have access to it. In some cases, however, we will instruct another person to process personal data for us, in which case we will have appropriate contracts in place with those individuals. In other cases (particularly in the case of brokerage), we transfer your personal data with your permission to companies whose products or services we broker for you.

Under the GDPR, you obviously have several rights that you can exercise depending on the legal basis on which we process your personal data. 11.1 Right of access

You have the right to obtain confirmation from us as to whether or not we are processing your personal data. If we do process your personal data, you have the right to obtain access to the personal data we process and the right to obtain a copy of such personal data.

11.2 Right to repair

We try to process only the most up-to-date information about you and delete the incorrect information after correction. However, this does not prevent you from asking us to correct personal data that is no longer up to date or is incorrect.

11.3 Right to erasure (right to be forgotten)

If we do not need your personal data, we delete it immediately. However, this does not change the fact that you have the right to have us delete (or anonymise) your personal data without delay, provided that one of the following reasons applies:

  • the personal data is no longer needed for the above purposes;
  • you withdraw your consent to the processing of personal data;
  • you object to a legitimate interest and we assess that this legitimate interest does not override your rights (in the case of marketing purposes based on legitimate interest, we will delete the data immediately);
  • processing was unlawful;
  • deletion is required by Czech or EU law.

However, this right is not absolute, as sometimes we may not be able to delete your personal data, this is in those cases where the processing is necessary:

  • for the exercise of the right to freedom of expression and information;
  • to fulfil a legal obligation;
  • for reasons of public interest in the field of public health;
  • for archiving purposes in the public interest, for scientific or historical research or for statistical purposes;
  • for the establishment, exercise or defence of legal claims.

However, it is quite possible that none of the above cases will occur at all, so you do not need to worry that we will not delete your personal data.

11.4 Right to restriction of processing

You also have the right to have us restrict the processing of your personal data in one of the following cases:

  • you deny the accuracy of the personal data for the time necessary to verify its accuracy;
  • the processing is unlawful, you will refuse to erase the personal data and you will require the restriction of its use;
  • we no longer need the personal data for processing purposes, but you require us to retain it for the establishment, exercise or defence of legal claims;
  • you raise an objection against a legitimate interest, pending an assessment of its validity.

11.5 Right to portability

Although it sounds strange, if we process your personal data by automated means and the processing is based on consent or necessity for the performance of a contract, you have the right to so-called portability. The right to portability guarantees that we will transmit the data you have provided to us in a commonly used and machine-readable format, or that we will transmit the data to another controller that you identify to us.

11.6 Right to object to processing on the basis of legitimate interest

Where we process your personal data on the basis of legitimate interest, you have the right to object to this processing on the basis of a reasoned objection. In the case of such processing for direct marketing purposes, you do not have to justify the request and we will immediately stop processing your personal data in accordance with the GDPR.

In other cases, we have the right to review your objection and assess whether your rights take precedence over our legitimate interests.

11.7 Right to withdraw consent

If we process your personal data on the basis of consent, you are of course entitled to refuse and withdraw your consent at any time. In this case, we will not continue with further processing and, unless we are prevented by law from doing so, we will delete your personal data.

However, if we also process your personal data on the basis of another legal title, we are not obliged (sometimes not even allowed) to delete the personal data.

11.8 Right to lodge a complaint with the Office for Personal Data Protection

If you believe that we are processing your personal data unlawfully, you are of course entitled to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection (www.uoou.cz).
